Constitutions are for Communists

In the spirit of "patriots" who want to criminalize flag-burning (thus missing the whole point of what the flag represents), I give you the small town of Pahrump, Nev.

The elected town board in the remote Mojave Desert community voted 3-2 on Tuesday to enact an ordinance making it illegal to fly a foreign nation's flag by itself.

Flying another country's flag, whether it is a British Union Jack or the flag of Mexico, is punishable by a $50 fine and 30 hours' community service, unless it is flown below an American flag.

Let me tell you, all the folks up here in Minnesota that fly Swedish and Norwegian flags are going to be a tad upset.

The flag measure wasn't the only piece of silly legislation to pass. Pahrump also made English the city's official language, and outlawed town benefits to illegal immigrants -- which cuts such immigrants off from.... nothing.

"We don't have any" benefits, town manager David Richards says. "If we ever have any, they'll be denied to illegal immigrants."

So what sparked this muscular show of contempt for constitutional rights?

The ordinance's sponsor, Michael Miraglia, a retired Illinois state worker, said the flag restriction was a reaction to nationwide demonstrations in May against a crackdown on illegal immigration. He said he didn't like seeing protesters waving Mexican flags and demanding immigrants not go to work that day.

"In Pahrump, we had Mexican restaurants closed that day," he complained. "Only one restaurant stayed open."

I see his point. Perhaps the board's next move should be to establish city-mandated hours of operation for all Mexican restaurants, to prevent such a thing from ever happening again.

Carville goes for Dean's throat

Rhetorically, anyway.

Carville ... said Democrats could have picked up as many as 50 House seats, instead of the nearly 30 they have so far.

The reason they didn’t, he said, is the Democratic National Committee did not spend some $6 million it could have put into so-called “third tier” House races against vulnerable Republicans....

Asked by a reporter whether Dean should be dumped, Carville replied, “In a word, do I think? Yes.”...

He added, “I would describe his leadership as Rumsfeldian in its competence.”

I refer you to my earlier post on the subject, which is that Carville frankly needs to get some perspective. Dean argued all along that it was foolish to compromise the party's 2008 chances in order to pick up a few extra seats in 2006. And he's right. The money he might have spent in this election cycle he is now free to put toward building out the party's infrastructure for 2008. That will do more to solidify the Democratic majority than would picking up a few extra seats while riding a tide of anti-incumbency.

Carville keeps trying to float this argument, and he keeps getting smacked down. Maybe someone should ask him politely to shut up.

Oh, wait. They are. Meanwhile, in the blogosphere, the request is not phrased quite so daintily.

WMDs FOUND IN IRAQ!!!!

Well, sort of. Okay, not really.

In case you had any doubts that Rick Santorum and Pete Hoekstra are idiots, I give you this:

Rep. Peter Hoekstra (R-Mich.), chairman of the House intelligence committee, and Sen. Rick Santorum (R-Pa.) told reporters yesterday that weapons of mass destruction had in fact been found in Iraq, despite acknowledgments by the White House and the insistence of the intelligence community that no such weapons had been discovered.

"We have found weapons of mass destruction in Iraq, chemical weapons," Santorum said.

The lawmakers pointed to an unclassified summary from a report by the National Ground Intelligence Center regarding 500 chemical munitions shells that had been buried near the Iranian border, and then long forgotten, by Iraqi troops during their eight-year war with Iran, which ended in 1988.

Saddam was known to have developed and used chemical weapons; we sold him the components for some of it, and his gas attacks against Kurdish villages are a component in his ongoing trial. Iraqi troops used poison gas during the Iraq-Iran war. We have previously found old artillery shells modified for chemical warfare.

What we have never found -- and still haven't -- is any indication that he had functioning stockpiles of chemical or biological weapons, or a functioning nuclear program. 15-year-old artillery shells do not constitute a reason to invade.

Even the Pentagon rejects the senators' contention:

Asked why the Bush administration, if it had known about the information since April or earlier, didn't advertise it, Hoekstra conjectured that the president has been forward-looking and concentrating on the development of a secure government in Iraq.

Offering the official administration response to FOX News, a senior Defense Department official pointed out that the chemical weapons were not in useable conditions.

"This does not reflect a capacity that was built up after 1991," the official said, adding the munitions "are not the WMDs this country and the rest of the world believed Iraq had, and not the WMDs for which this country went to war."

Idiots.

Found: Missing idiot

And his name is Lynn Westmoreland, R-Ga. He appeared on "The Colbert Report" last night. Crooks and Liars has the transcript:

COLBERT: You have not introduced a single piece of legislation since you entered Congress.

WESTMORELAND: That's correct.

COLBERT: This has been called a do nothing Congress. Is it safe to say you're the do nothingest?

WESTMORELAND: I, I, ..Well there's one other do nothiner. I don't know who that is, but they're a Democrat.

COLBERT: What can we get rid of to balance the budget?

WESTMORELAND: The Dept. of Education.

COLBERT: What are the Ten Commandments?

WESTMORELAND: You mean all of them?--Um... Don't murder. Don't lie. Don't steal Um... I can't name them all.

That last exchange is lovely because he's a co-sponsor of various bills letting the Ten Commandments be displayed in government buildings. To find the text of the bills, check Thomas for "Ten Commandments" or specifically H RES. #214 and H CON. RES. #12.

He also was caught distributing auto-industry talking points verbatim to colleagues under his own letterhead, without attribution.

Rove won't be indicted

Looks like Truthout was just plain wrong:

Special Counsel Patrick Fitzgerald has told White House aide Karl Rove that he does not expect to seek charges against him in connection with the CIA leak case, Rove's lawyer said today.

In a statement this morning, Robert Luskin, Rove's attorney, said that Fitzgerald "has formally advised us that he does not anticipate seeking charges" against Rove.

"In deference to the pending case, we will not make any further public statements about the subject matter of the investigation," Luskin said in the statement. "We believe that the Special Counsel's decision should put an end to the baseless speculation about Mr. Rove's conduct."

That leaves just Lewis Libby on the hotseat. The White House breathes a small sigh of relief, though it's a sign of the difficulties they're in that "relief" is defined as "only one White House insider charged."

Does that end the buzz? Hardly. There's plenty of room for speculation, because somebody outed Plame. As Fitzgerald has noted, Libby being charged with cover-up crimes -- and nothing else -- indicates the the coverup was successful.

So unless something explosive comes out of the Libby trial, this is probably the end of the legal side of the Plame case. But it does not exonerate the White House, or Rove, or Cheney -- it simply fails to convict them. The only other hope for clarity lies in Fitzgerald's final report. It will detail what he knows and what he doesn't know, and why he chose to charge Libby and no one else. At that point we'll be able to judge the clarity or murkiness of the accusations and the defenses.

Three deaths at Gitmo

After four years of being jailed without charge, and multiple attempts by various prisoners, three inmates at Gitmo finally succeeded in hanging themselves over the weekend.

That might be controversial enough; I'll get into the basic implications of the deaths a little later. But the U.S. stoked the flames of world outrage by dismissing the suicides as a "good PR move."

The suicides by hanging of the three men, two Saudis and one Yemeni, on Saturday sparked renewed calls from foreign governments and human rights groups for the military facility to be closed or moved.

About 465 foreign nationals are being held there without charge, some for almost four years. Yesterday, however, Colleen Graffy, a senior State Department official, dismissed the suicides as a “good PR move to draw attention” and “a tactic to further the jihadi cause”.

The camp commander described the men as dangerous extremists would go to any lengths to become martyrs. “They are smart, they are creative, they are committed,” Rear Admiral Harry Harris said. “This was not an act of desperation, but an act of asymmetrical warfare waged against us.”

I cannot imagine a dumber thing for us to say. There may be a kernel of truth there, the idea that some extremists are willing to die in order to advance their cause. But all the suicides do is call renewed attention to the embarassment that is Gitmo. The real damage is that the "They died? Oh well" response suggests to the world that we couldn't care less about prisoner rights or safety. It suggest that we follow certain guidelines for prisoner treatment not out of conviction but because we are expected to.

To our credit -- though too late -- cooler heads quickly backpedaled from those initial remarks:

Deputy Assistant Secretary of Defense for Detainee Affairs Cully Stimson, speaking to BBC radio, distanced himself from the statements.

"I wouldn't characterize it as a good PR move. What I would say is that we are always concerned when someone takes his own life. Because as Americans, we value life, even the lives of violent terrorists who are captured waging war against our country," he said.

In the aftermath of the earlier statements, Stimson's remarks sound like so much spin.

On the one hand, it's possible to read too much into the "PR stunt" line: that defense was offered by relatively junior officials, and then contradicted by more senior officials.

But it reveals an attitude held by at least some of the people responsible for guarding and protecting prisoners and waging the fight against terrorists. It also seems to expose a curious laissez-faire attitude on the part of the Bush administration's publicity machine. When something as momentous as three prisoner deaths occur, why did they leave the response to such junior officials? Especially junior officials who had apparently not been briefed on what to say? Where was Bush? Where was Rice? Where was Rumsfeld?

Other than the damage done by such rhetorical foot-shooting, what do the deaths mean? Well, I've long said that Gitmo is an indefensible legal and moral catastrophe, and argued that the prisoners either need to be charged with crimes, labeled as POWs or released. I've also said that the existence of Gitmo does us more harm than good, and should be shuttered for that reason alone.

The deaths don't change that. They may highlight the unAmerican injustice going on there; they may speak to the increasing hopelessness of the prisoners; they may (and have) fueled renewed outrage and pressure to close the facility. But Gitmo should never have been opened for the reasons it was, or operated in the manner it has been. No amount of "humane treatment" makes up for creating a deliberate legal limbo in which human beings can disappear for years at a time. No amount of "administrative review" makes up for such clear proof that the rule of law is only for those people that we say it's for, rather than a deeply held principle that we apply to everyone accused of wrongdoing.

The deaths don't change the debate. They simply point out, in ever starker terms, what made Gitmo a bad idea in the first place.

Shut it down.

The next step in judicial conservatism

.... is to re-argue case law that has been settled for more than 100 years.

Well, actually, it's not so much re-arguing as simply ignoring precedents that one doesn't like.

In a debate with powerful echoes of the turbulent civil rights era, four Republicans running for Alabama's Supreme Court are making an argument legal scholars thought was settled in the 1800s: that state courts are not bound by
U.S. Supreme Court precedents.

The Constitution says federal law trumps state laws, and legal experts say there is general agreement that state courts must defer to the U.S. Supreme Court on matters of federal law.

Yet Justice Tom Parker, who is running for chief justice, argues that state judges should refuse to follow U.S. Supreme Court precedents they believe to be erroneous. Three other GOP candidates in Tuesday's primary have made nearly identical arguments.

"State supreme court judges should not follow obviously wrong decisions simply because they are 'precedents,'" Parker wrote in a newspaper opinion piece in January that was prompted by a murder case that came before the Alabama high court.

Yeah, why, if everybody followed precedents you'd have... uh... a consistent body of law.

It might dismay you to learn that Parker currently sits on the Alabama Supreme Court. But it will surprise you not at all to learn that Parker is a former aide to Roy Moore, who was forced to resign as Alabama's chief justice in 2003 over a Ten Commandments monument he had secretly installed in his courthouse.

Incompetence in Iraq

If you want to get mad, read this.

As chaos swept Iraq after the American invasion in 2003, the Pentagon began its effort to rebuild the Iraqi police with a mere dozen advisers. Overmatched from the start, one was sent to train a 4,000-officer unit to guard power plants and other utilities. A second to advise 500 commanders in Baghdad. Another to organize a border patrol for the entire country. ...

Before the war, the Bush administration dismissed as unnecessary a plan backed by the Justice Department to rebuild the police force by deploying thousands of American civilian trainers. Current and former administration officials said they were relying on a Central Intelligence Agency assessment that said the Iraqi police were well trained. The C.I.A. said its assessment conveyed nothing of the sort.

After Baghdad fell, when a majority of Iraqi police officers abandoned their posts, a second proposal by a Justice Department team calling for 6,600 police trainers was reduced to 1,500, and then never carried out. During the first eight months of the occupation — as crime soared and the insurgency took hold — the United States deployed 50 police advisers in Iraq.

Against the objections of Colin L. Powell, then the secretary of state, the long-range plan was eventually reduced to 500 trainers. One result was a police captain from North Carolina having 40 Americans to train 20,000 Iraqi police across four provinces in southern Iraq.

You mean the Bush administration based policy on a complete fantasy, and executed the plan with extreme incompetence? Man, that's hard to believe....

I've said several times that, no matter what you think of the rightness of going into Iraq, we should all be incensed by the sheer incompetence of the execution. From sending in too few troops (and now too few policemen) to secure the country, to disbanding the Iraqi army, to lowballing cost estimates, to the near-complete lack of planning for the occupation, to the ignoring of the ethnic and religious divisions that had been papered over by Saddam, this administration has screwed up just about everything it undertook in relation to Iraq. The result is that even if we do "win" in Iraq -- however you define that -- the cost will be far, far higher than it needed to be.

New taxes dead, pander still on life support

Senate Republicans can act quickly when necessary -- such as when their business allies object to proposed new taxes.

Senate Republicans on Monday hurriedly abandoned a broad tax proposal opposed by the oil industry and business leaders, another sign of their struggle to come up with an acceptable political and legislative answer to high gasoline prices.

Senator Bill Frist of Tennessee, the majority leader, said he had decided to jettison the provision, which would have generated billions of dollars by changing the way businesses treat inventories for tax purposes. Instead, he said the Senate Finance Committee would hold hearings on the plan "later this year, so the pluses and minuses of the provision can become well known."

I actually think the proposal should never have been made in the first place: oil company profits are the least of my worries. But it shows once again how clueless Frist is.

Meanwhile, the $100 rebate plan has not yet had its plug pulled. But sweet merciful death can't be far away, especially because income from the tax provision is supposed to pay for the rebate.

The centerpiece of the leadership proposal, a $100 rebate check to compensate taxpayers for higher gasoline prices, continued to receive a rough reception. Members of the public have telephoned and written to ridicule the idea, and even Republican lawmakers are finding fault.

"Political anxiety in an election year is to blame for a lot of the bad bills Congress passes," said Representative Jeff Flake, Republican of Arizona, who on Monday called the rebate a "knee-jerk populist idea" that voters would see through.

The rest of the bill has some other elements:
The measure includes new protections against price gouging, incentives to expand domestic oil refinery capacity, support for new energy initiatives and tax incentives for buying hybrid vehicles.

Ditch the price-gouging protections, because I have yet to see evidence of it being a widespread problem and anyway I want gas to be more expensive. Expanding refining capacity is fine, because refining is the main bottleneck in our energy supply line. But tax incentives are less important than overcoming political and environmental opposition to their construction.

Support for new energy initiatives is fine as long as it's different sources of energy, not just drilling in ANWR and other such measures that will have no short-term effect and in the long-term will just provide an excuse to continue our oil dependence -- all while incurring lasting environmental damage.

Tax incentives for hybrids is nice, but misses the point. Target the tax incentive at fuel efficiency, not one particular type of motor. I don't care if the car is a hybrid design or not; all I care about is that it gets 50 miles to the gallon.

I'll also note, yet again, that all of these tax incentives and funding options and so on and so forth would be totally unnecessary if we do one thing: keep the price of gas high. Do that, and people will pursue the other options on their own, out of naked self-interest.

What do they think will happen?

Critical as I am of the decision to invade Iraq and much of our execution during the post-war occupation, I don't quite get antiwar protesters.

The third anniversary of the U.S.-led war in Iraq drew tens of thousands of protesters around the globe, from hurricane-ravaged Louisiana to Australia, with chants of "Stop the War" and calls for the withdrawal of troops.

As my wife, another war critic, said, "we should get a bumper sticker saying 'Insurgents go home!' "

While a large chunk of the Iraqi resistance is sparked by our presence and will go away when we leave, another large chunk is driven by sectarian goals and the foreign fighters under Al-Zarqawi appear interested in triggering a civil war. Both of the latter would be helped by a precipitous withdrawal. It can be difficult to identify good guys in Iraq, where tit-for-tat killings are becoming common, but I think most people would agree that the latter two groups definitely count as bad guys.

It angers me no end that the Bush administration started this war in the first place, and then dug the hole so deep that we have no choice but to keep digging. But we really have no honorable choice. We must withdraw on our own timetable, not rush for the exits now that the war is going poorly and becoming more and more unpopular. There's nothing wrong with a timetable, but it had better be contingent upon certain milestones being reached -- with a Plan B in case those milestones are judged to be unreachable.

Why an independent press is important

If you ever want an example of why we should not allow the government to regulate the press, here's one.

Douglas County Coordinator Bill Schalow last Monday sent an eight-point protocol to Echo Press reporter Erin Klegstad, requesting that she submit stories to his office for accuracy checks and go through the office to set up interviews.

"If you willfully ignore this request," it concluded, "or fail to cooperate and comply without contacting me first regarding your concerns, your actions could result in a total system 'gag' and limit your interaction with the county to the coordinator's office only."

Klegstad - who had to call Schalow to find out if he was serious (he said he was) - showed the e-mail to Al Edenloff, the paper's editor.

"I was shocked," Edenloff said. "I thought it was the most ridiculous document I'd ever read. ... We do not need our stories to be pre-authorized, prearranged or sanitized. We're the watchdogs, not them."

The Minnesota Newspaper Association's attorney, Mark Anfinson, said the protocol seemed to violate not only the First Amendment but also the state's open records law.

"This is something you would have expected to see behind the Iron Curtain," Anfinson said. "I told (Edenloff) that the best remedy for this would be a story, that it wouldn't stand the light of day."

That's what happened. When the news broke, the public was infuriated, and some county leaders who hadn't seen the policy said they didn't support it. Schalow quickly backed off.

Irritated as we can sometimes get about perceived excesses by an out-of-control press, the alternative is worse. It's quite refreshing that the citizens of Douglas County not only recognize that, but felt it was important enough to do something about it.

U.S. reclassifying National Archive documents

The government continues to exhibit its penchant for excessive secrecy:

WASHINGTON, Feb. 20 -- In a seven-year-old secret program at the National Archives, intelligence agencies have been removing from public access thousands of historical documents that were available for years, including some already published by the State Department and others photocopied years ago by private historians.

Mr. Leonard said he ordered the audit after reviewing 16 withdrawn documents and concluding that none should be secret.

"If those sample records were removed because somebody thought they were classified, I'm shocked and disappointed," Mr. Leonard said in an interview. "It just boggles the mind."

Things like this are why I'm generally unimpressed by the mere fact that a leaked document is classified. The government routinely classifies stuff that has no business being classified. Leaking such information is against the letter of the law, but it does not violate the law's spirit, nor is it unethical or treasonous.

To determine if a leak is wrong, you have to first determine if the information in question deserved to be secret to begin with. Allowing the government to keep every little thing secret makes it impossible to know what the government is up to, and thus impossible to monitor or regulate it. This can be poisonous to democracy.

For instance, here's an example of a "reclassified" document:

a 1962 telegram from George F. Kennan, then ambassador to Yugoslavia, containing an English translation of a Belgrade newspaper article on China's nuclear weapons program.

Government information should be viewed with the presumption that it is a public record, and only classified if the administration can show sufficient cause. This is in fact the case:

Under existing guidelines, government documents are supposed to be declassified after 25 years unless there is particular reason to keep them secret.

But without oversight and review, nothing stops an official from classifying anything they want.
